Definitely Bay dun. I've been trying to breed dun out of my Pindos ponies for what seems like forever.
I've seen tons of these.

Well we all agree it's dun. I'm afraid the real horse that is labelled a "buckskin grulla" is mislabeled entirely. This is because buckskin (bay base with a cream gene) and grulla (black base with a dun gene) are mutually exclusive. A horse can't be both bay and black based. The HWO pony is certainly a bay dun. The real horse looks grulla. It might have a single cream gene like a buckskin, but it doesn't show up on black based coats.

It is also important to remember that the HWO bay duns can be really, really dark compared to real bay dun horses 
But as long as they look brown-ish in the head, along the dorsal or on the legs they are bay-based and not black-based
