You're right; it's a bay. He's not dark though, when you try to describe the shade of bay, it is the body shade you are looking at. His body is very red, so he can be described as "blood bay", or "red blood bay" or such things.
But only "bay" is fully sufficient.

As you may see, she is also bay-based. She is very coppery-yellow, and this is typical for buckskins. A buckskin is a bay horse that happened to get one copy of the cream gene which dilutes brown pigment (so her body is lighter) but not black pigment (she her legs, mane, tail, ear tips and muzzle are left black).
She also looks like she is sooty around her shoulder, which is fairly common for buckskins.
So she might be described as buckskin or possibly sooty buckskin.

Now, she is pure red and nothing black at her at all. So she is not bay (which requires black legs, mane, tail, ear tips and muzzle). She is a chestnut.

Dark bay is just a different shade of bay, which is black + Agouti. It's not defined, as in you can't say "this is definitely a dark bay and not a normal bay", just a matter of personal preference. Neither "dark bay" nor "cherry bay" or "mahogany bay" are official names. If you like to, you can write "dark bay", that's up to you :)
